Boat rentals, pool and dock are only for guests of Bavarian Resort. Please fill out the form below to verify that you are staying with us. Upon boat rental you will need to accept the Waiver And Release Agreement.
Upon form submission you will be able to choose your boat rental plan.
WAIVER AND RELEASE AGREEMENT
Please read carefully.
This is a release of liability and waiver of certain legal rights.
In consideration for my being permitted to participate in the activities of renting and operating a pontoon boat, I agree to the following Waiver and Release:
I acknowledge that renting and operating a pontoon boat has inherent risks, hazards, and dangers for anyone that cannot be eliminated, particularly in a wilderness environment. I UNDERSTAND THAT THESE RISKS, HAZARDS, AND DANGERS INCLUDE WITHOUT LIMITATION:
- Water hazards in boating and wading in the rivers including drowning
- Hiking in rugged country
- Injuries from fishing equipment and other participants
- Encounters with wildlife, animals, and insects
- Temperature extremes
- Inclement weather conditions and unavailability of immediate medical attention in the wilderness in case of injury
I understand the risks, hazards, and dangers of renting and operating a pontoon boat and have had the opportunity to discuss them with . I understand that these activities may require physical conditioning and a degree of skill and knowledge. I believe I have that good physical conditioning and the degree of skill and knowledge necessary for me to engage in these activities safely. I understand that I have responsibilities. My participation in this activity is purely voluntary. No one is forcing me to participate and I elect to participate in spite of the risks.
I AM VOLUNTARILY USING THE SERVICES OF WITH FULL KNOWLEDGE OF THE INHERENT RISKS, HAZARDS, AND DANGERS INVOLVED AND HEREBY ASSUME AND ACCEPT ANY AND ALL RISKS OF INJURY, PARALYSIS, OR DEATH.
Lastly, I, for myself, my heirs, successors, executors, and subrogees, hereby KNOWINGLY AND INTENTIONALLY WAIVE AND RELEASE, INDEMNIFY AND HOLD HARMLESS their directors, officers, agents, employees, and volunteers from and against any and all claims, actions, causes of action, liabilities, suits, expenses (including reasonable attorneys' fees) which are related to, arise out of, or are in any way connected with my participation in this activity including, but not limited to, NEGLIGENCE of any kind or nature, whether foreseen or unforeseen, arising directly or indirectly out of any damage, loss, injury, paralysis, or death to me or my property as a result of my engaging in these activities or the use of these services, animals or equipment, whether such damage, loss, injury, paralysis, or death results from negligence of or from some other cause. I, for myself, my heirs, my successors, executors, and subrogees, further agree not to sue as a result of any injury, paralysis, or death suffered in connection with my use and participation in the activities of renting and operating a pontoon boat.
Don't Forget Your
Boater's Safety Card
If you are born after Jan. 1, 1984 you must show a boating safety ID Card to rent a boat. Avoid unnecessary delays by getting your boater's safety card online before you arrive.
WE HOPE TO SEE YOU ON THE LAKE!
All boats are full of gas when rented and need to be returned in the same condition.
All boats come equipped with all necessary equipment to be legal on the water, including fire extinguisher, paddle and life jackets.
Life jackets are included with rental, including life jackets for children. If you have a personal life jacket you would prefer for yourself or your children, please bring them. All children 7 and younger must wear a life jacket at all times.
No pets or BBQ grills allowed on rental boats.
Boats must be returned in time so that they can be cleaned and fueled for the next customer.
Anyone born after 1/1/1984 must have a boater's safety certificate to operate a boat. If your state does not require a boater's safety certificate, take the Missouri course.
